It's a cursed item if you affected by the "bad" effect even if you're not using the weapon or even after you get rid of the weapon. Since Devil's Dice only occurs if you draw the weapon, it's not a cursed item.

As written, you could draw the weapon, and if you roll a 2 or 3, just never sheathe the sword again and you'll keep that damage bonus. Maybe make those damage bonuses last 1 minute. Marasmusine (talk) 04:07, 12 April 2015 (MDT)

4e used "encounter" as a demarkation, but 5e seems to use "1 minute" instead (unless I've missed something, there are no class features or spells that are "until the end of the encounter", it's always 1 minute, 10 miniutes, 1 hour...) Marasmusine (talk) 05:48, 12 April 2015 (MDT)
